1. Terms of use

1.1 Location

The company site is housed in Canada. The company does not make any deception that part or whole of it is site may be used outside Canada, and it is not permitted to gain access to the site from outside Canada where legislation would prove the site to be illegal. Those that decide to use this site do it of there own accord and they must conform to the applicable local laws. All claims relative to the site and it’s elements or from use of the site adheres to the applicable laws of the province of Quebec.

2 General sales conditions

2.1 Pricing

2.1.1 Fees for shipping and transport, and all taxes are added to the affixed price.

2.1.2 The company reserves the right to at anytime change the pricing without any warning.

2.1.3 All prices are in Canadian dollars.

2.2 Returns

2.2.1 You can return products to the company at any time, as long as it has not been longer than 30 days from the date of purchase. Returns shall be sent to this address: Le sommetdu vélo inc. 1323 ave de la Gaudarville, Québec, Quebec, Canada, G2G 2K6. The product must be accompanied by a proof of purchase and the order number.

2.2.2 You must pay for the fees to return the product and assume responsibility for the risks to the products during shipping (unless you have received an article that was not ordered and or you receive the wrong product this also includes articles that were received with damages. Therefore the company will assume the payment for transport and accept responsibility for the product when you return the article through a shipper that ensures the condition of the product being sent.)

2.2.3 In accordance with 2.2.1 and 2.2.2 you may not return articles that have been used, unless they are faulty.

2.2.4 On reception of the product the company will reimburse the some of the debit from you credit card account, the fees for shipping and handling will be returned as soon as possible, on condition that the products returned by you and received by the company is in the same condition that it was sent to you.

2.3 Product availability

2.3.1 If the company can not send you one or other products that you ordered because of stocking problems (back order), the company will advise you by e mail. Therefore you will have the following options.

2.3.1.1 Ask that we send the ordered product, where a payment will be taken from your credit card, before we will send the product;

2.3.1.2 Refuse delivery of the product, where no payment will be taken from your credit card;

2.4 Product delivery

2.4.1 The company will send the ordered product to the address that you have provided.

2.4.2 Delivery fees correspond to the article that has been ordered. In accordance with the size and weight, the postal cost may raise slightly higher then the foreseen fee for the product delivery.

2.4.3 Delivery will be provided by the company as quick as possible after the confirmation of your order, In accordance with the postal preference that you have selected. Delays and delivery fees may very from location in accordance with the delivery destination, the delivery method and the availability of the product. Delivery time is calculated from the time the product leaves the company?s place of business.

2.4.4 You will become owner of the product once the ordered product has been delivered by the courier. From this time on, you will become responsible and the company is not responsible for the loss or destruction of the article.

2.4.5 For all products that are mailed outside of Canada, you are responsible for all cost, fees and inherent costs that may apply when exporting outside of Canada.

2.4.6 Posting of products is subject to the rules courier companies that the company may deal with, at this time FedEx, Canada Post, and UPS, plus any other courier that the company may do business with. You are also subject to the rules concerning the need for signatures in accepting products. If you are not present at the mailing address when the courier presents himself, it will be your responsibility to recover the product in accordance with the courier?s rules that you have chosen while ordering the product.

2.4.7 No delivery will be made to a Post office Box.

2.4.8 The Company must have received complete payment for the product before it is shipped to you.

2.5 Responsibility

2.5.1 If or when the responsibility of the company in your regards can be held, it will be limited to the amount of money equal to that of the price you paid for a return product.
